The JPO will revise the guidelines for written requests for extension submitted after April 1, 2016, as follows.
The new guidelines will also apply to applications for which a response period passes after April 1, 2016 and for which the written request for extension is submitted after April 1, 2016.
(Patents)
If the applicant is a resident abroad;
(1)One(first) written request will result in an extension of the period by two(2) months and two(second) written request will result in an extension of the period by one(1) month (maximum of a three-month extension). You can submit one(first) written request and two(second) written request together at the same time. No justifiable reason is needed.
The official fee for above request is 2,100 JPY/ one request.
(2)You can submit one written request even after the expiration of response period (you have to submit it within two(2) months from the expiration of response period). One written request will result in an extension of the period by two(2) months (maximum of a two-month extension). No justifiable reason is needed.
The official fee for above request is 51,000 JPY
You can not submit this request if your request for above (1) case was admitted.
(Trademark)
If the applicant is a resident abroad;
(1)One written request will result in an extension of the period by one(1) month (maximum of a one month extension). No justifiable reason is needed.
The official fee for above request is 2,100 JPY/ one request.
(2)You can submit one written request even after the expiration of response period (you have to submit it within two(2) months from the expiration of response period). One written request will result in an extension of the period by two(2) months (maximum of a two-month extension). No justifiable reason is needed.
The official fee for above request is 4,200 JPY
You can not submit this request if your request for above (1) case was admitted.
